Session retainer fee
A. Session Fees
Client agrees to pay Stonybrook Photography $50.00 at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee for your session. The remainder of the session balance is due the date of the session The package price covers the time and talent of photographer, basic retouching of images as determined by the photographer, an online proof gallery of at least 40 images to make selections from. After the images have been selected Stonybrook photography will mail the client a disc via USPS. Complex editing is available at additional expense to be determined by photographer. Prints, Albums, Photo blocks, cards and additional digital images are available for purchase. Images will not be processed and/or prints will not be ordered until payment in full is received.
Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control.
Client is required to give the photographer 48 hours notice if client cannot attend their scheduled session time. If client needs to reschedule they may do so with in 1 month of their scheduled session date pending photogrpher’s availability. If the client fails to give 48 hours notice, then client forfeits the $50.00 retainer fee. (some exceptions may apply)
C. Re-shoots / Refunds
Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for tardiness of the client(s), poor choices of clothing, make-up, hair, weather related issues or tired/uncooperative children/adults.
D. Session Policy
Stonybrook Photography will be the exclusive photographer with no other camera or recording devices permitted during your session. Any amount of time the client is late will be deducted from their session time. If the client does not arrive in the first 30 minutes of the session, the session will be canceled and not rescheduled. (some exceptions may apply)
E. Archive of Session Images
After three (3) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. It is important that the client back up their own files or purchase an additional disc from Stonybrook Photography.
Photographer is not responsible for the damage of portraits or discs after delivery to client, Client assumes all responsibility for the safety of all portraits upon receipt.
G. Model Release
I hereby give to Stonybrook Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others: a) To copyright the same in the photographer’s name or any other name that he/she may select; b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and; I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
Stonybrook Photography retains all copyrights to all images created during client’s session. A print release is included with digital files to print portraits for personal use only. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by Stonybrook Photography during client’s photo session. Digital images and prints purchased from photographers can only be used for personal use and not for commercial, political, or any for-profit uses. A separate commercial release can be purchased if the images need to be used for anything other than personal use. Sharing on personal social media pages, web pages, or blogs is allowable.
Stonybrook Photography is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
Stonybrook Photography takes the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date.
J. PRINT LIFE
Client is aware that color dyes and inks in non-archival prints may fade or discolor over time due to the inherent qualities of dyes and inks, and Client releases Photographer from any liability for claims whatsoever based upon the fading or discoloration when prints are not purchased from photographer. Prints purchased from the photographer are guaranteed against natural light fading and will be replaced in the case of unexpected fading.
By purchasing this session I have read, understand and accept the terms of this portrait contract with Stonybrook Photography.
